By creating an account or using the Qooky app, you agree to these Terms of Service. If you don’t agree, please don’t use the app.
Qooky helps you avoid leaving things behind when you leave Home or Work, by detecting those moments through your location and reminding you to check your checklist. A free version is available with manual checklists only; a paid subscription unlocks automated detection and unlimited custom items.
You must be at least 16 years old to use Qooky. By using the app, you confirm that you meet this requirement.
You’re responsible for keeping your account credentials secure and for all activity under your account. Let us know right away at hello@qookyapp.com if you suspect unauthorized access.
The free tier gives you manual checklists only — no automatic geofence detection — and caps custom items at 2 per checklist.
Paid plans are $4.99 per week or $39.99 per year, each preceded by a 3-day free trial with full access to every feature. Unless you cancel before the trial ends, it automatically converts into a paid subscription and you’ll be charged the plan price.
Subscriptions renew automatically at the end of each billing period (weekly or yearly) unless cancelled at least 24 hours before the renewal date.
All subscriptions are billed and managed through the Apple App Store or Google Play, and we cannot process cancellations, refunds, or billing changes directly — you manage and cancel your subscription in your App Store or Google Play account settings. Refunds are subject to Apple’s and Google’s own refund policies, not ours.
If you’re in the UK, consumer law normally gives you 14 days to withdraw from a purchase of digital content without giving a reason. Because Qooky’s paid plans start with a 3-day free trial, you can cancel at any point during those first 3 days at no cost whatsoever, which covers the same purpose as the withdrawal right for the trial period itself.
Once your trial converts to a paid subscription and payment is taken, you are acknowledging that performance of the digital service (continued access to Qooky’s paid features) has begun with your consent, and that you thereby lose the 14-day withdrawal right for that billing period, consistent with the digital-content exception in the UK’s Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You can still cancel auto-renewal at any time to prevent future charges — see Section 5.
You agree not to:
Qooky is a convenience reminder tool. It is not a safety, security, or medical device, and it is not a substitute for your own judgment or responsibility.
Background detection depends on your device’s location services working correctly, having a working internet or cellular connection, sufficient battery, and the operating system actually running the background task when expected — none of which we can guarantee. Reminders may be delayed, may not fire, or may fire late.
You remain solely responsible for your medication, keys, documents, wallet, and your own personal safety and the safety of others. Do not rely on Qooky as your only safeguard for anything where forgetting has serious consequences.
Qooky is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the app will be uninterrupted, error-free, or that reminders will always fire correctly or on time.
To the fullest extent permitted by law, Indomitable Lion LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, property, or personal harm, arising from your use of or inability to use Qooky — including harm resulting from a reminder that didn’t fire, fired late, or was inaccurate. Our total liability for any claim relating to the app will not exceed the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for death or personal injury caused by negligence, where such a limitation is not permitted).
You can stop using Qooky and delete your account at any time (see our hello@qookyapp.com deletion process in the Privacy Policy). We may suspend or terminate your access if you violate these Terms, misuse the app, or for security or legal reasons. If we terminate your account for reasons other than your own violation, we’ll make reasonable efforts to notify you first.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. This does not deprive you of the protection of any mandatory consumer-protection provisions of the country you live in.
If a dispute arises, please contact us first at hello@qookyapp.com so we can try to resolve it informally. If we can’t resolve it that way, the dispute will be handled in the courts of the State of Wyoming, except where applicable law gives you the right to bring a claim in your own country’s courts (for example, as a UK consumer).
We may update these Terms from time to time. If we make material changes, we’ll notify you in the app or by email before they take effect. Continuing to use Qooky after changes take effect means you accept the updated Terms.
